The situation on the Pequannock continues to unfold. A new permit has been proposed with a hearing date of May 13.
We have been discussing our concerns with the new permit requirements for the release at Oak Ridge Reservoir with the DEP. It has come to light that the DEP is basing the new conditions on the false assumption that cold bottom water is always released at this site. However, there is nothing in the new permit to ensure this. Basing their new protections on this false assumption is not good policy. Also, the new requirements provide a bare minimum of protection. In the DEP’s scientific models, this is fine. In the real world it’s a recipe for problems. A margin of safety is needed.
Hopefully we can work these issues out without the necessity of appealing this permit and heading for court. Right now, we believe that a solution is likely. I wish to thank all those who have been emailing Commissioner Mark Mauriello and sending in letters. Your support makes a big difference.
Now, an important step forward. The DEP has informed me that, beginning on May 1st, the new permit conditions requiring a 5 cfs flow from the Charlottesburg Reservoir into the lower Pequannock River will go into effect. That means, for the first time in a century, the lower Pequannock River will NOT be drained to bare rock in the summer. This is a huge achievement for PRC, and for all our members and friends who have helped us through this long and difficult process.
Of course, there is still much to be done on the river and the current permit issues are still unresolved. But the gains are already great. Please join me in sharing the pride of this accomplishment!
